Problems with the Digital Certificate in Spain

In Spain there is some confusion regarding the request for a digital certificate of a non-resident company.

The first problem that needs to be resolved is to understand who should appear in the Certification Authority's offices, if he or she must go in person or delegate this task. The answer is that anyone can handle the request, but not on the basis of a Power of Attorney. In fact, the Tax Agency will act as a bridge between the Certification Authority and the Company. The latter may apply for the Certificate and download it directly from the offices outside Spain.

It is important to consider that you cannot apply for a Certificate of Sole Director of a non resident Company because it is not registered in the Spanish Companies Registry. This means that the Company should apply for a Digital Certificate of "Representante de Persona Jurídica", which serves for relations with the Spanish Public Administration.
